Tort Claims and Litigation:
A significant portion of our practice is devoted to the defense of vessel
interests in cases involving maritime personal injury and death, property
loss and economic damages. We represent clients against claims brought
by businesses, and by seamen, longshore and harbor workers, passengers
and contractors, and in related indemnity actions before state and federal
courts and arbitrators. The firm has been at the forefront of legislative
and judicial tort reform, resisting unwarranted application of U.S. jurisdiction
in cases involving foreign litigants and transactions.
Kaye, Rose & Partners, LLP has often defended against high profile cases, such as class actions stemming from alleged shipboard food or water contamination, consumer and competitor claims for unfair trade practices, suits involving ADA compliance, shipboard navigational accidents and crimes.
Our experience includes involvement in landmark cases in state and federal appellate courts and the U.S. Supreme Court, both as counsel of record and amicus curiae for the cruise, commercial shipping and marine insurance industries. We have regularly represented owners, employers, concessionaires, tour operators and manufacturers in cases involving aviation, scuba diving and marine recreational accidents, industrial and consumer product liability, commercial sportfishing, purse seining and marine explosions. We have also defended against medical malpractice suits arising from shipboard treatment, referral and evacuations.
